CDL ticket penalties can be harsh

Fighting a CDL ticket on your own can be a foolish proposition. Penalties can be harsh and unforgiving.

For some CDL ticket convictions, you can face severe penalties that can threaten your livelihood. For example, if you are convicted of a railroad highway grade crossing violation, you could be disqualified from driving for 60 days for a first violation. That increases to 120 days for a second violation within any three-year period.

If you are convicted of two serious violations within three years, you could lose your license for 60 days. Three convictions within three years will result in a 120-day disqualification. Serious violations include excessive speed of more than 15 mph over the posted speed limit, reckless driving, negligent driving, following too close, improper lane changes, overtaking on the right and other similar violations.

Drivers can also be disqualified for at least one year if they are convicted of DUI with an alcohol concentration of .04 or more, leaving the scene of an accident, using a commercial vehicle in the commission of a felony or refusing to take a blood-alcohol test. Disqualifications are bumped up to three years is you are convicted of any of these violations while transporting hazardous materials.

Lifetime disqualifications will result if you receive a second conviction for any of the above listed offenses or you use a commercial vehicle to commit a felony involving the manufacture or distribution of a controlled substance.
