Even the safest and most experienced commercial drivers are at risk of getting a CDL ticket sooner or later
When a person drives a truck for a living, they are on the road constantly. Because the safety of every driver on the road is of utmost importance, the need for strict enforcement of all applicable traffic laws in California can leave little margin for error for commercial drivers. Unfortunately, even the best drivers can make mistakes from time to time. But because so much is at stake and because commercial driving laws are so stringent, the consequences can be costly. That’s why if you’re a commercial driver and you do get a ticket, it’s imperative that you immediately retain the services of a skilled and experienced commercial drivers traffic ticket lawyer.
At Leicht Law, we understand the gravity of your situation, and we have been assisting commercial drivers for many years in fighting their tickets, maintaining a clean driving record, and preserving their ability to keep making a living as a commercial driver.
CDL ticket penalties can be harsh
Fighting a CDL ticket on your own can be a foolish proposition. Penalties can be harsh and unforgiving.
For some CDL ticket convictions, you can face severe penalties that can threaten your livelihood. For example, if you are convicted of a railroad highway grade crossing violation, you could be disqualified from driving for 60 days for a first violation. That increases to 120 days for a second violation within any three-year period.
If you are convicted of two serious violations within three years, you could lose your license for 60 days. Three convictions within three years will result in a 120-day disqualification. Serious violations include excessive speed of more than 15 mph over the posted speed limit, reckless driving, negligent driving, following too close, improper lane changes, overtaking on the right and other similar violations.
Drivers can also be disqualified for at least one year if they are convicted of DUI with an alcohol concentration of .04 or more, leaving the scene of an accident, using a commercial vehicle in the commission of a felony or refusing to take a blood-alcohol test. Disqualifications are bumped up to three years is you are convicted of any of these violations while transporting hazardous materials.
Lifetime disqualifications will result if you receive a second conviction for any of the above listed offenses or you use a commercial vehicle to commit a felony involving the manufacture or distribution of a controlled substance.
Obviously, the stakes are high with the threat of any type of conviction hanging over your head if you are a commercial vehicle operator. That means you must do everything in your power to preserve the use of your CDL which also preserves your ability to make a living. At Leicht Law, we understand the gravity of your situation and will work with you to aggressively take all the steps necessary to maintain your innocence.
